1. Acceptance of Terms
By accessing or using our website or services, you agree to these Terms. If you do not agree, do not use the services.
2. Description of Services
FaithForm.io provides:
- AI-powered phone reception systems
- Automation workflows
- Communication tools
- Website and social media automation
- Operational software for churches
We reserve the right to modify or discontinue services at any time, subject to the notice provisions in Section 15.
3. Accounts
To access certain features, you may need to:
- Create an account
- Provide accurate information
- Maintain confidentiality of login credentials
You are responsible for all activity under your account.
4. Payment Terms
- Subscription fees are billed monthly or annually.
- Fees are non-refundable unless otherwise stated in writing.
- We may suspend services for failed payments.
We reserve the right to change pricing with reasonable advance notice.
5. AI & Automation
Our services include AI-generated content, summaries, and automated responses powered by third-party AI providers including OpenAI, Anthropic (Claude), and Google Cloud AI. You acknowledge that:
- AI outputs may contain inaccuracies or errors.
- You are responsible for reviewing AI-generated content before relying on it or distributing it.
- We are not liable for decisions made based on AI outputs.
- If you use FaithForm's outbound communication automation features (automated texts, emails, or calls sent to your congregation or contacts), you are responsible for ensuring that you have obtained all required consents from those recipients under applicable law, including the Telephone Consumer Protection Act (TCPA) and any applicable state law. FaithForm provides the automation tools; you are the sender and the data controller responsible for lawful use.
6. Acceptable Use
You agree NOT to:
- Use services for unlawful purposes
- Upload malicious code
- Attempt to reverse engineer systems
- Use AI tools for spam or harassment
- Interfere with system security
Violation may result in immediate termination.
7. Data Ownership
You retain ownership of:
- Uploaded content
- Church data
- Messages and communications
We retain ownership of:
- Platform infrastructure
- Software
- AI systems
- Branding and intellectual property
8. Confidentiality
We will not disclose your confidential information except to provide services or as required by law.
9. Data Processing Terms
9.1 Roles. When you use FaithForm's services, you (the church or organization) are the data controller in respect of your congregation and organizational data. FaithForm acts as a data processor, processing that data only on your instructions and as described in these Terms and our Privacy Policy.
9.2 Scope of processing. FaithForm processes your data for the following purposes: (a) providing and maintaining the services you have subscribed to; (b) operating and improving the FaithForm platform, using only FaithForm-native data as described in our Privacy Policy; and (c) complying with legal obligations. We will not process your data for any other purpose without your prior written consent.
9.3 Sub-Processors. You authorize FaithForm to engage the Sub-Processors listed in Section 4 of our Privacy Policy to assist in delivering the services. We will notify you at least 30 days before adding or replacing a material Sub-Processor. If you have a reasonable objection to a new Sub-Processor, contact privacy@faithform.io and we will work with you to address the concern.
9.4 Security. FaithForm will implement and maintain appropriate technical and organizational security measures to protect your data against unauthorized access, disclosure, alteration, or destruction, consistent with Section 6 of the Privacy Policy.
9.5 Your data requests. If you receive a data access, correction, or deletion request from one of your congregation members or contacts, and that request relates to data we hold on your behalf, notify us at privacy@faithform.io. We will provide reasonable assistance to help you respond within the timeframes required by applicable law.
9.6 Breach notification. If FaithForm becomes aware of a confirmed security breach affecting your data, we will notify you within 72 hours of confirmation (to the extent permitted by law), as set out in Section 6A of our Privacy Policy.
9.7 Data return and deletion. Upon termination of your FaithForm subscription, we will make your data available for export for a period of 30 days following the termination effective date. After that export window, we will delete or destroy your data from our active systems within a further 30 days, except for data we are required to retain by applicable law. We will confirm deletion in writing upon request.
9.8 COPPA representation. You represent and warrant that you will not submit to FaithForm, or cause FaithForm to collect or process, personal information belonging to children under the age of 13 without first obtaining appropriate verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA) and applicable law. If you provide a youth program, children's ministry, or similar service and wish to use FaithForm for data relating to minors, contact us at privacy@faithform.io to discuss appropriate data handling arrangements before doing so.
10. Indemnification
You agree to indemnify and hold harmless FaithForm.io from claims arising from: your misuse of the service; violation of laws (including TCPA, COPPA, or applicable privacy law); or breach of these Terms.
11. Limitation of Liability
To the fullest extent permitted by law, FaithForm.io shall not be liable for: indirect damages; lost profits; data loss; or service interruptions. Our total liability shall not exceed the amount paid by you in the previous 12 months.
12. Security Incidents
In the event of a security incident affecting your data, FaithForm's obligations and procedures are set out in Section 6A (Security Incident Notification) of our Privacy Policy, which is incorporated into these Terms by reference. Our breach notification obligations to you are also set out in Section 9.6 of these Terms above.
13. Termination
We may suspend or terminate access if: you violate these Terms; payment fails; or use harms the platform or other users. You may cancel at any time. Except as otherwise agreed in writing, subscription fees are non-refundable on cancellation. Sections 7, 8, 9, 10, 11, 14, and 15 survive termination.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
14A. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or their breach shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with proceedings conducted in Louisville, Kentucky. The arbitrator may award any remedy available at law. Notwithstanding the foregoing, either party may seek preliminary injunctive or other equitable relief from any court of competent jurisdiction to protect its intellectual property or confidential information. This arbitration agreement does not apply to disputes within the jurisdiction of small claims court.
15. Service Changes and Continuity
We will provide at least 30 days' advance written notice by email before making material changes to our services, significantly changing pricing, or discontinuing a feature that active subscribers rely upon. We reserve the right to modify or discontinue the service immediately and without notice in the event of a security emergency, abuse of the platform, or violation of these Terms. In the event of service discontinuation, Section 9.7 (data return and deletion) applies.
16. Changes to These Terms
We may update these Terms at any time. For material changes, we will provide at least 30 days' advance notice by email. Continued use after the notice period constitutes acceptance of the updated Terms.
